Purposes of personal data processing

Guided by the legislation on the protection of personal data, G.A.P.A. performs processing of personal data of polo.am user strictly in accordance with the following processing objectives:

Methods of personal data processing

Processing of personal data of polo.am user is performed by G.A.P.A. and other third parties, mainly by electronic and telematic means.

Processing of personal data is carried out with the consent of personal data subject to the processing of his personal data.

The personal data of polo.am user can not be transferred abroad to countries that are not parties to the Strasbourg Convention of the Council of Europe on the protection of individuals in the automated processing of personal data in 1981 and to countries not included in the list of countries that provide adequate protection of personal data (this list is approved by the user's country authorized body for protection of personal data subjects’ rights) without the prior consent of the personal data subject. For example, an exception may be cases where the above action is necessary to provide services and / or to fulfill a contract for the sale of goods with G.A.P.A., goods ordered on polo.am (and also in other cases provided by the current legislation). G.A.P.A. processes personal data for direct marketing purposes, for sending messages about new commercial initiatives related solely to the activities and services of this website, by e-mail, by mail, by phone (sms, calls), only after obtaining consent from the subject of personal data.

In the absence of the consent of such third parties, the polo.am user is solely responsible for the disclosure of information and data relating to these third parties (as well as in connection with any other incompatible and unlawful use of such data). G.A.P.A. also informs that the consent of such third parties is not required if the personal data of these persons have already been communicated by these third parties through the purchase of polo.am.

Personal data of user polo.am are kept by G.A.P.A. until the withdrawal of consent to the processing of personal data directly by personal data subject.

In case personal data subject wishes G.A.P.A. to cease processing his personal data or update such data, he / she can apply to G.A.P.A. by phone or by e-mail in the section of the Customer Service, indicating the topic "Privacy Policy".

G.A.P.A. processes personal data of third parties interested in establishing business relations with the Company G.A.P.A. only for these purposes.

4. What Happens if You Do Not Disclose Your Personal Data to G.A.P.A.

Your personal data supplied to G.A.P.A. (in particular, your personal details, your e-mail address, your address, your credit card numbers and bank code and your telephone number), are necessary for the processing of your order for the purchase of products on polo.am, to supply other services provided on the website upon your request, or when your personal data needed to carry out obligations arising out of applicable laws or regulations.

4. Call - center - for purposes related to the functioning of the call center and the customer service departments available to the polo.am user.

In addition, personal data on the official request can be transferred to the police or other competent authorities in accordance with the norms of the current legislation (for example, if G.A.P.A. is required to contribute to the prevention of fraud at polo.am).

In all the cases described above, the individual consent of the personal data subject to the processing of personal data is not required.

Personal data is not disclosed, disseminated or transmitted to third parties without prior notification of personal data subjects about such disclosure, distribution or transfer without their consent (if the need for such consent is provided for by law).

The mandatory or optional nature of personal data provision to G.A.P.A.

Personal data provided to G.A.P.A. 5. processed personal data relating to the relevant personal data subject, the source of their receipt;

6. terms of processing of personal data, including the terms of their storage;

7. the procedure for the subject to exercise personal data rights;

8. information on the transboundary data transfer that has been or is being expected;

9. the name or name and surname and address of the individual or legal entity that handles the processing of personal data on behalf of the operator, if the processing is entrusted or will be entrusted to a third party;

10. other information provided by the current legislation.

In order to obtain the above information, the subject of personal data may apply to G.A.P.A. by phone or by e-mail in the section of the Customer Service, selecting the topic "Privacy Policy".

Also, personal data subject has the right at any time to demand from G.A.P.A. to perform or perform the following actions by him/herself:

1. clarification of his personal data, their blocking or destruction in the event that personal data are incomplete, outdated, inaccurate, illegally obtained or are not necessary for the stated purpose of processing, and also take measures provided by law to protect their rights;

2. for legitimate reasons, express an objection, in whole or in part, to the processing of his personal data, even if it relates to the purposes for which the data was collected;

Consent and refusal of personal data subjects

G.A.P.A. handles personal data only after receiving personal data from a particular subject of freely expressed consent.

Separate prior consent is required to send him promotional materials, direct marketing materials or other commercial information messages related to the services provided by G.A.P.A., including by mail, by e-mail, by phone (calls, sms).

Every time, in accordance with the legislation in force, the consent of the personal data subject to the processing of his personal data is required, G.A.P.A. in advance will notify him/her of this and give the opportunity to express such consent in the manner indicated.

Governing Law

G.A.P.A, being an Armenian company, carries out its activities in accordance with the legislation of the Republic of Armenia. In addition, the site: //www.polo.am/ operates in accordance with the requirements of the legislation of the Republic of Armenia on the protection of personal data.

All disputes, disagreements or demands arising in connection with the use of the polo.am website are subject to consideration in the court of Yerevan (Armenia), which has exclusive jurisdiction.

Modification and Updating of polo.am Privacy Policy

G.A.P.A. may amend or simply update all or part of polo.am's Privacy Policy, in consideration of amendments to legal provisions or regulations which govern data protection and protect your rights. The amendments and the updating of polo.am Privacy Policy shall be notified to our users on polo.am's homepage as soon as such amendments or updates have been introduced and shall be binding as soon as they are published on the website in this section.

Polo.am delivers via mail services FedEx, Major-Express and EMS on the basis of contracts.

The cost of delivery is not included in the price of the goods, it is calculated using an online calculator and depends on the country and city of delivery.

Polo.am does not carry out a trading margin on the delivery services, the estimated cost takes into account the corporate discount received from our partners.

The responsibility for the safety of the goods during the delivery is borne by the postal service that carries out exact delivery.

Return Policy

Our purpose is to guarantee your full satisfaction. If, for any reason whatsoever, you are not satisfied with your order, you may exercise your right to return purchased products within ten (10) days from the date on which you received them from polo.am. The products you want to return must be received by G.A.P.A. within thirty (30) days from the date the package was delivered to you. The products may be returned using a shipping agent of your choice.

It is necessary to send a corresponding message on the website in Customer Service area or to the address of [email protected], necessarily indicating the order number in the message, after which we will process the return.

It is not possible to return an item in exchange for another.

Terms and Conditions of Return
The right to return products shall be deemed correctly exercised once the following conditions have been fully met:

a. a request for return with indication of the order number must be submitted to polo.am within ten (10) days from the date of your receipt thereof;
b. the products have not been used, worn, washed, modified or damaged; 
c. the identification tag is still attached to the products with the disposable seal; 
d. the products must be returned, complete and unused, in their original packaging;
e. G.A.P.A. must receive the goods within thirty (30) days from the date the package was delivered to you.

If you have fulfilled all requirements set forth above, G.A.P.A. shall refund the entire price for the returned purchased products. Any duties, taxes and fees you have paid for the delivery of the purchased products shall not be refunded. You will be notified if the returned products cannot be accepted. In this case, you may choose to have the products delivered to you at no expense by G.A.P.A.. If you refuse the above delivery, G.A.P.A. reserves the right to retain the products and the amount paid for your purchase of the products. 
Please note that any duties, taxes and fees you have paid for the delivery of the purchased products shall not be refunded.

Return Shipping
You can ship your returns to G.A.P.A. with a shipping service of your choice and the return shipping will be at your own expense. Please verify that you have accurately completed and included with your package all the necessary documentation for Customs clearance. We recommend that you consult with local authorities and/or your selected shipping service to ensure that the documentation is sufficient. G.A.P.A. cannot be held responsible for parcels that are detained at Customs because of lacking or insufficient documentation. G.A.P.A. therefore highly recommends that you choose a shipping service that permits you to trace it at any time. Be sure that the type of shipping you choose guarantees the delivery of the parcel within the time frame of thirty (30) days from the date on which you received your order.

Refund Times and Procedures
After G.A.P.A. has received the returned products and checked that the products meet all requirements, you will receive an e-mail that the returned products have been accepted. Whatever form of payment you used (Credit or Debit Card, PayPal), the refund procedure will start within 30 days from when G.A.P.A. was informed of your decision to exercise your right to return the purchased products and once G.A.P.A. has checked that the return was carried out in compliance with the above conditions.
In case of confirmation of the refund, the amount paid for the initial delivery of the goods is also subject to payment.
The time period for refunding the amount you paid for purchasing the returned products depends on the form of payment used:
- purchase by Credit/Debit Card: refund time will depend on the card company’s policies.
- for purchase by PayPal: refunds are made to the PayPal account; the crediting is displayed immediately.

In the case of gifts, the refund of the sums paid for purchases will be made to the individual who made the payment.

Disposable Seal
All products sold by G.A.P.A. include an identification tag attached complete with a disposable seal. Please try on the products without removing the tag and seal. Returned products without the tag or seal will not be accepted.

1. Our Business Policy

G.A.P.A. offers products for sale on polo.am and its e-commerce business services are available exclusively to its end users, i.e. the "Consumers".

"Consumer" shall mean any individual who is acting for purposes which are outside his or her trade, business or profession. If you are not a Consumer, please do not buy any products on polo.am.

G.A.P.A. reserves the right not to process orders received from users who are not "Consumers" and any other order which does not comply with G.A.P.A.'s business policy.

These General Terms and Conditions of Sale exclusively regulate the offer, transmission and acceptance of purchase orders relating to products on polo.am between the users of polo.am and G.A.P.A..

The General Terms and Conditions of Sale do not regulate the supply of services or the sale of products performed by third parties that are on polo.am through links, banners or other hypertext links. Before sending orders and purchasing products and services from those third parties, we recommend that you verify the third party's terms and conditions, since G.A.P.A. shall under no circumstances be deemed liable for the supply of services provided by third parties or for the execution of e-commerce transactions between users of polo.am and third parties. 

2. How to Execute a Contract with G.A.P.A.

In order to place an order for the purchase of one or more products on polo.am, you must fill in the online order form and send it electronically to G.A.P.A., following the relevant instructions.

The order form contains a link to these General Terms and Conditions of Sale, and also contains information on the main characteristics of each product ordered and the relevant unit price, the type of payment that you may use in order to purchase each product, shipping terms for the purchased products, shipping and shipping costs, and references to the terms and conditions for returning purchased products. 

2.3 
An order shall be deemed submitted when G.A.P.A. receives your order form electronically and the order's information has been verified as correct. 

2.4 
Before submitting your order form for the purchase of products, you will be asked to carefully read the General Terms and Conditions of Sale, to print a copy using the print option and to save or reproduce a copy thereof for your own personal use. 

2.5 
The order form will be filed in our data base for the time required to process your order and as provided by law. 

2.6 
Before submitting the order form, you will be asked to identify and correct possible input errors.

The submission of orders to G.A.P.A. must be in English.

After your order form has been submitted, G.A.P.A. will process your order.

G.A.P.A. may not process purchases when there are not sufficient guarantees of solvency, when orders are incomplete or incorrect, or the products are no longer available. In the above cases, we shall inform you by e-mail that the contract has not been executed and that G.A.P.A. has not carried out your purchase order specifying the reasons thereof. If the products displayed on polo.am are no longer available at the time of your last access or once G.A.P.A. has received your order form, G.A.P.A. shall inform you of the unavailability of the ordered products within thirty (30) days from the day after G.A.P.A. has received your order. 
If the order form has been sent and the price has been paid for items that are no longer available, G.A.P.A. will refund the amount paid for those items. 

2.10 
By submitting an order form to G.A.P.A., you unconditionally accept and undertake to observe the provisions of these General Terms and Conditions of Sale in your contract with G.A.P.A.. Should you not agree with certain provisions of these General Terms and Conditions of Sale, please do not submit your order form for the purchase of products on polo.am.

By submitting an order form, you agree and accept these General Terms and Conditions of Sale as well as further conditions contained on polo.am, also through links, including the General Terms and Conditions, Privacy Policy, Return Policy. 

2.12 
Upon submission of an order form, G.A.P.A. shall send you a purchase order receipt e-mail, containing a summary of the information related to the order form (General Terms and Conditions of Sale, the products' main characteristics, detailed information on price, terms of payment, return policy and shipping costs). 
Please note that all and any item price is provided without duties, taxes or fees that you may need to pay to local authorities to receive the merchandise. Please note as well that due to fluctuations in exchange rates and merchandise components G.A.P.A. will not be able to provide you in advance with information on the amount of duties and taxes that may be owed to local authorities. These amounts should be considered above and beyond the total of the order. 

3. Guarantees and Product Price Indication

On polo.am we offer high-quality goods for sale. These products are manufactured by G.A.P.A. and are carefully selected based on strict quality control procedures used.

3.2 
G.A.P.A. does not sell second-hand products, flawed products or products of lower quality than the corresponding market standards.  

3.3 
The main characteristics of products are shown on polo.am on each product page. The products offered for sale on polo.am may not exactly correspond to the real garments in terms of image and colours due to the Internet browser or monitor used. 

3.4 
Prices are subject to change. Check the final price of sale before sending the relevant order form. 

3.5 
Orders made from a Country site different from the one you are shipping to, or to addresses to which G.A.P.A. cannot ship, will be automatically cancelled. 

3.6 
All products come with an identification tag attached with a disposable seal. Do not remove the tag or seal from the purchased products should you wish to return the purchased product. 

3.7 
Should you decide to exercise your right to return purchased products, G.A.P.A. has the right to not accept returned products that are returned without the corresponding tag or seal or that have been altered from their original status or damaged. 

4. Payments

4.1
Payment of the product prices and relevant shipping costs must be made by using one of the procedures indicated on the order form. 

4.2 
In case of payment by Credit Card or Debit Card, all details (for example, Card Number or Expiration Date) will be sent by encrypted protocol to the banks which provide remote electronic payment services, without third parties having any access thereto whatsoever. Such details will not be used by G.A.P.A. except for performing the procedure relevant to your purchase or issuing refunds in the case of returns, in compliance with the exercise of your return right or for reporting cases of fraud to the police. The price for the purchase of products and the relevant shipping costs, as indicated in the order form, will be charged to your current account when the purchase is finally confirmed. 

5. Customs and Duties

5.1
Upon arrival in your Country the contents of your order may be subject to Customs fees (taxes, duties, processing fees, brokerage fees, etc.), which are responsibility of the customer receiving the order. These fees are not under G.A.P.A.'s control. For this reason we recommend you verify with your local Customs office before you place an order. G.A.P.A. is unable to estimate customs fees, taxes, duties, etc. so please contact your local authorities or Customs office for detailed information. 

5.2 
Both the item prices as well as the shipping charges you pay to G.A.P.A. do NOT include Customs fees, import taxes, brokerage fees, or duties. 

5.3 
Should you refuse your order at the time of arrival or should you refuse to pay the Customs fees when your order arrives, the shipment will be returned to G.A.P.A. and we will be charged the Customs fees plus return shipping costs. If you receive your order and accept to pay the Customs fees upon delivey, G.A.P.A. will not issue refunds for the same in case of return of the purchased products.

Customs processing may delay the delivery of your order. Should you experience such delays please check with your local Customs offices. The invoice for the Customs fees could arrive weeks after you receive your order, separately from the same. 

6. Shipping and Delivery of the Products

We would like our channels in social networks (Facebook and Instagram) also to serve as a platform for communication and exchange of information.

These pages are open to all and have the purpose of communication between users. Below are briefly stated the unacceptable forms of behavior:

a) We are pleased to receive your feedback and comments if relevant: we reserve the right to delete those comments that are not relevant to the topic of the specific discussion that are related to the activities of external sites or to commercial sales promotions not authorized by G.A.P.A.

b) We remove comments from users who are obscene or infringe the dignity of the administrator, moderator or other users of a particular page. There will also be no comments that offend different minorities: ethnic, political, religious, etc.

c) Comments that violate copyrights or contain references to registered trademarks will not be considered to be unacceptable without prior authorization from them.

In this regard, we would like to remind you that no illegal actions are allowed that carry a threat or slander or are aimed at the dissemination of personal data of third parties without their consent. In these cases, we will contact the appropriate authorities.

If we deem it necessary, we will notify Facebook and Instagram about this content. In addition, after repeated violations of the listed rules of conduct, the user responsible for publication may be blocked.

We also urge you not to distribute any information relating directly or indirectly to your orders, issued on our sites, or your personal data. If you need help, send us a request via private message. Otherwise we will ask you to continue the dialogue in personal correspondence, thus providing direct and private access to our Customer Service, which in this case reserves the right not to respond to requests in public correspondence (chat).

8. Returns

8.1 
You may return products purchased from polo.am, without any penalty and without specifying the reason, within ten (10) days from receiving the products purchased on polo.am. 

8.2 
It is necessary to send a corresponding message on the website in Customer Service area or to the address of [email protected], necessarily indicating the order number in the message, after which we will process the return. 

8.3 
G.A.P.A. must receive the returned products within thirty (30) days from the date on which products were received by you.

The return right - besides compliance with the terms and procedures described at par. 8.1, 8.2, 8.3 and 8.4 above - shall be deemed correctly exercised once the following conditions have been fully met:

a.     the online Return request must be submitted within ten (10) days from receipt of the order;

b.     the products must not have been used, worn, washed or damaged;

c.     the identification tag must still be attached to the products with the disposable seal;

d.     the products must be returned, complete and unused, in their original packaging;

e.     G.A.P.A. must receive the goods within thirty (30) days from the date in which you receive your order.

8.6 
If the return right is exercised in conformity with the provisions set forth in this section, G.A.P.A. shall refund the amounts paid for the returned products and shipping costs. Any duties, taxes and fees on the products purchased shall not be refunded. 

8.7 
G.A.P.A. shall refund the amount already paid for the purchase of products and the shipping costs for the delivery of the purchased products to you only if the products are returned for reasons that may be due to G.A.P.A., such as when the products do not have the promised essential characteristics or have manufacturing defects or they have been erroneously delivered. 

8.8 
G.A.P.A. shall refund amounts already paid as soon as possible and in any case within thirty (30) days from the date on which G.A.P.A. becomes aware of your decision to exercise your return right. After having confirmed that the terms and conditions stated above have been duly complied with, G.A.P.A. will promptly start the refund procedure as indicated in section 10. 

8.9 
In the event that your return does not comply with the terms and conditions set out in section 8 of these General Terms and Conditions of Sale, you will not be entitled to any refund of sums already paid to G.A.P.A.; nevertheless, you shall be entitled, at your own expense, to receive the products in the conditions in which they were sent back to G.A.P.A.. If you do not wish to receive the products in the conditions in which they were sent back to G.A.P.A., G.A.P.A. shall be entitled to keep the products and withhold the sums already received. 

9. Refund Times and Procedures

9.1 
After the products have been returned, G.A.P.A. shall check the conformity of the products with the conditions indicated in section 8 above. When G.A.P.A. is able to confirm that such conditions have been met, G.A.P.A. shall send you an e-mail confirming the acceptance of the returned products. 

9.2
Whatever payment type you used, the refund procedure shall be started by G.A.P.A. within thirty (30) days from when G.A.P.A. was informed of your decision to exercise your return right, after checking that the return right has been correctly exercised and that the returned products have been accepted. 

9.3 
If the recipient of the products indicated in the order form is different from the individual who made the payment for such products, the amount paid for returned items shall be refunded by G.A.P.A. to the individual who made the payment.
